The Rowan County Zoning Board of Adjustment will hold a hearing Monday concerning a potential racetrack on Beagle Club Road.

According to documents, the 5.3-acre tract property, owned by William David Eller and Traci Poole Eller, has been used by the family as a racetrack. However, the property is zoned rural agricultural, which would make operation of a racetrack a zoning violation. On Feb. 1, after receiving several complaints, the couple was issued a warning citation by Rowan County Ordinance Enforcement, and a first citation for violation was issued on Feb. 22. The Ellers paid the $25 fine, and filed an appeal of the decision on March 2.

“The zoning code does not define a racetrack,” the Ellers wrote in their appeal. “The actual use of the property is for ATV vehicles on a course. There is no race activity, no public attendance and no other factors described in the zoning ordinance about racetracks that brings the use of RA land for the driving of an ATV into the scope of the ordinance. The vehicles used specifically do not meet the definition of go-kart nor the operation of a motor speedway/drag strip.”

The board will meet Monday at 6 p.m. in the Rowan County Administration Building J. Newton Cohen, Sr. meeting room, 130 W. Innes St.
