RALEIGH (AP) — Sam Ervin IV and Kristin Ruth will compete in November for one seat on the state Court of Appeals after incumbent Judge John Tyson lost his seat in a primary election Tuesday.Ervin, a member of the state Utilities Commission, had 37 percent of the vote and Ruth, a judge in Wake County District Court, had 26 percent with 99 percent of precincts reporting. The two leading vote-getters in the nonpartisan race advance to the general election. Tyson had 22 percent to lose the seat he first claimed in 2000.

RALEIGH (AP) — A pair of state senators — Republican Robert Pittenger and Democrat Walter Dalton — will face each other this fall in the race for lieutenant governor after winning party primaries in Tuesday’s election.There was no such resolution in the Democratic race for labor commissioner, which appears headed for a runoff. Pittenger beat three Republicans hoping to win the state’s No. 2 post. With 97 percent of precincts reporting unofficial results, Pittenger had 59 percent of the vote. The Charlotte businessman had received endorsements from Sen. Elizabeth Dole and former Gov. Jim Martin, and focused his campaign on what he called inefficiency in government and on lowering state tax rates.
