Nominate a John Roberts-like Democrat

What Obama should be looking for is someone who sees the role of a justice much like John Roberts outlined it in his confirmation hearings: “Judges are like umpires. Umpires don’t make the rules; they apply them. The role of an umpire and a judge is critical. They make sure everybody plays by the rules, but it is a limited role.” Roberts and Kennedy, appointed by Republican presidents, have sometimes disappointed Republicans.

… Sure, Obama’s submission of a doomed choice now could be used to tar the GOP as intransigent and rally the Democratic faithful on behalf of the party’s presidential nominee.

By taking that route, though, Obama would not only assure a protracted vacancy on the court but drive a bigger wedge between the two parties on Capitol Hill. If he wants to establish “a new way of doing business,” this is his chance.

Here’s a bright-side scenario for Democrats:

Because of Justice Scalia’s death and the resulting 4-4 Supreme Court tie. Democrats win big cases like redistricting in N.C.

Then President Obama nominates a replacement (or a series of them) that Republicans reject, solidifying their reputation as bitter partisans who are willing to hurt America so long as they also hurt Obama. Which elects Hillary Clinton. Who nominates Obama to the Supreme Court. Where he’ll serve until 2040 if he lives as long as Scalia. Then Obama can really change America. Because, as Marco Rubio says, he knows exactly what he’s doing.

Unlike the Republicans.
