ENOCHVILLE — A Mooresville man has been charged with statutory rape and a statutory sex offense on a 14-year-old girl, and is in the Rowan County jail under a $150,000 secured bond.
According to a report by the Rowan County Sheriff’s Office, authorities were called to NorthEast Medical Center April 28 about a sexual assault involving a 14-year-old girl and 20-year-old Stephen Michael Smith. It was found that the incident happened two days earlier, on April 26, the report said.
Tracy Mikolay, at the hospital with the juvenile, was asked why she didn’t contact law enforcement sooner, and Mikolay said she didn’t want to get law enforcement involved and didn’t want to press charges, the report said.
The juvenile told authorities she met Smith on Facebook, and he and another man came to her residence, went into the juvenile’s bedroom and were there for several hours while Mikolay was also in the residence.
The report said Mikolay was aware that Smith was 20 years old.
On May 19, Detective Sarah Benfield met with Rowan County Assistant District Attorney Tim Goude and determined a misdemeanor charge of contributing to the delinquency of a minor against Mikolay was sufficient, and charges against Smith were also discussed, the report said.
The charges against Mikolay were reviewed by District Attorney Brandy Cook, the report said, and it was determined that a felony child abuse charge was more accurate. The magistrate found probable cause, and warrants were issued for both Mikolay and Smith.
On May 20 Mikolay turned herself in to authorities and was given a $15,000 secured bond.
Smith turned himself in to Iredell County authorities on May 22, and he was transferred to the Rowan County jail Monday and given a $150,000 secured bond.
