Details Inc. must pay $100,000 in back overtime

MOORESVILLE — Mooresville-based Details Inc. has agreed to pay $100,315 in back overtime wages to 117 employees, according to the U.S. Department of Labor.

The federal agency’s Wage and Hour Division determined the company violated the Fair Labor Standards Act. “The employer failed to properly pay overtime to employees who worked across the country installing equipment in home improvement stores that had not yet opened for business,” John Blaine, Charlotte district director for the Wage and Hour Division, said in a press release.

Federal investigators found that between April 2004 and April 2006, Details Inc. paid workers on a semi-monthly basis. The company based overtime payments on the semi-monthly time period “rather than paying overtime after 40 hours per week as prescribed by law,” the federal agency said.

“In addition, field employees were not paid for the time spent traveling from one job site to another during a work day.”

The Fair Labor Standards Act requires employers to pay “covered non-exempt” workers 1 1/2 times their regular pay for time in excess of 40 hours in a week. Employers also must pay workers for travel time between job sites during the week.

“The company cooperated with investigators and agreed to future compliance with the law and to maintain accurate records of employees’ wages, hours and other conditions of employment,” the federal agency said.
