A Cleveland man with a lengthy criminal history has been charged with threatening a pregnant Rowan County Department of Social Services attorney.
Curtis Dean Hayes, 44, of 145 Rocky Point Road, was charged late last week with threatening an executive legal court officer.
According to an arrest warrant, Hayes threatened to kill the unborn baby of Cynthia Barnhill Dry, who is the attorney for the Department of Social Services.
He told her twice “you better watch your f–king back b–ch,” according to the warrant.
Hayes also told a third party that he was going to kill her unborn baby, the warrant said.
The incident happened Thursday following a court proceeding in which Hayes was involved.
Dry said she did not want to discuss a pending case, citing a confidentiality clause.
Hayes was released from the Rowan County jail after posting a $7,500 bond.
Court records show the conditions of his release included not going near Dry’s residence and staying away from the Department of Social Services unless given prior permission to go there.
Rowan County court records show Hayes has been charged numerous times with assault on a female, which is a misdemeanor. The file indicated that Hayes was found not guilty in 2004 of assault on a female. Instead, a Cheryl Hayes was convicted of frivolous prosecution. In the same case, Curtis Hayes was charged with domestic violence, but not convicted.
In July 2005, he was charged with assault on a female but convicted of the lesser offense of simple assault. He received two years of unsupervised probation.
Three months later, Hayes was charged with misdemeanor assault inflicting serious injury. The case was dismissed by the court.
In 2007, an assault on a female charge was dismissed by the court. Cheryl Hayes was again convicted of frivolous prosecution.
In Iredell County, Curtis Hayes was found guilty in 1994 of felony selling cocaine. He was also charged with possession with the intent to manufacture, sell and deliver cocaine but convicted of the lesser offense of felony possession of cocaine. In the same year, authorities dismissed a charge of maintaining a dwelling to keep controlled substances.
He was found guilty in 1991 of assault on a female, resisting a public officer and misdemeanor larceny.
In 1990, he was charged with breaking and entering but convicted of the lesser offense of second-degree trespassing. That same day, the district attorney dismissed a charge of second-degree kidnapping. A year later, the district attorney dismissed a charge of simple assault.
Also in Iredell County, Hayes was convicted in 1986 of being intoxicated and disruptive. The district attorney dismissed a charge of assault with a deadly weapon.
Hayes was found guilty of misdemeanor larceny four times during the late 1990s.
He was convicted of misdemeanor larceny in Yadkin County in 1998 and of the same charge in Cabarrus County in 2004.
He was convicted of breaking and entering in 1998.
Some charges against Hayes were dismissed because the victim did not show up in court, records show.
Hayes also has multiple traffic infractions and charges of making harassing phone calls.
Hayes has a pending case of hit and run/failure to stop for property damage and failure to stop for a stop sign/flashing red light. The trial is slated for March. A trial for a speeding charge is scheduled for this month.
Hayes’ next court appearance is Feb. 13.
