Salisbury Planning Board to reconsider rezoning request

SALISBURY — The Salisbury Planning Board will revisit a request to rezone property on Gold Hill Drive for a low-income apartment complex.

The meeting will be at 4 p.m. Tuesday in City Hall, 217 S. Main St.


Members voted 4-3 earlier this month to kill a motion that would have recommended City Council approve the rezoning and a conditional district overlay for Summerfield Apartments.

Charlotte developer Jud Little wants to build the 80-unit, rent-controlled complex and clubhouse on 12 acres with an entrance and exit on Gold Hill Drive.

Some Planning Board members said they could not support the development because it didn’t adhere to the Eastern Gateway Plan, a guiding document that volunteers and city staff worked for years to create. Summerfield’s density would have been higher than the density recommended in the gateway plan.

A planning board committee has been working to find a compromise.

Little wanted to build a similar apartment complex last year behind the new Aldi but failed to win tax credit financing from the N.C. Housing Finance Agency (another developer is now pursuing the project behind Aldi). Little will once again compete for tax credit financing for Summerfield.

If the apartments are built, people who qualify to live in Summerfield would earn between $17,000 and $34,000 a year.

Also on Tuesday’s agenda:

• Requests to change the base zoning for Colonial Village apartments to residential mixed use to remove a nonconforming situation and then apply a conditional district overlay to allow for a campus-style development, allow the developer to replace all existing roofs and construct a new community building near the entrance. 

This development currently exists and violates a policy in the Vision 2020 Plan by allowing entry and exit through a lower-density neighborhood, but staff notes that these were in place before the adoption of the Vision 2020 Plan. 

Staff recommends approval of the rezoning and application of the conditional district overlay.

• Requests for special use permits from Lee Street Theater, 329 N. Lee St., to allow a bar or lounge as part of the theater program and from J&J Tire and Auto Center, 401 Bringle Ferry Road, to allow vehicle services, major repair and body work within an existing building located.
