Midwife submits to lower court's decision

SALISBURY — A woman who appealed her conviction of unlawfully practicing midwifery in 2011 remanded her case to a lower court’s decision.

Emily “Amy” Hyatt Medwin pleaded not guilty in April 2011, but was found guilty in district court. She appealed her sentence to superior court.

Medwin, of East Bend, accompanied by her lawyer, James Davis, appeared in Rowan Superior Court Monday, where her case was remanded to district court.

In remanding her case, Medwin agreed to the terms that were set in her case during the 2011 district court proceedings.

Medwin was given two years unsupervised probation and is to not practice midwifery in this state without a license.

North Carolina only allows certified nurse midwives, who must attend nursing school, to practice. The state does not recognize Certified Professional Midwives.

She was charged in February 2011 following the death of a baby in western Rowan County a month earlier. The baby died of natural causes.

Medwin, who is licensed to practice in Virginia, was requested to assist in the birth as she had done for the couple’s two boys.
