Salisbury Police officers shot and killed a man early Sunday after he fired at them, they say.
The shooting happened at the Civic Apartments at 715 Hall St., near the J.C. Price American Legion Post.
According to police, the man who was killed was a suspect in an armed robbery.
He was being pursued by one officer when he rounded a corner of the apartments and found himself facing three other officers.
"The male produced a handgun and fired it at the officers," reads a news release from the Police Department. "Officers returned fire, striking the suspect."
Police Chief Mark Wilhelm said the three officers who were fired upon apparently all returned fire. The suspect was hit more than once and died at the scene.
After daybreak Sunday, numerous shell casings remained spread about the site, which was cordoned off by police tape.
"It's just by the grace of God he didn't hit one of our officers," Wilhelm said.
According to police, the incident began at 2:09 a.m. when a woman called 911, saying she had been robbed at gunpoint while pumping gas at the Rushco station at the intersection of Jake Alexander Boulevard and Mooresville Road.
She told dispatchers that four males involved in the robbery fled driving a white Toyota Camry. The woman gave the dispatcher a partial license number and said one of the vehicle's windows was broken out and covered with plastic.
Another witness said he saw the suspect vehicle behind Harris Teeter at the intersection of Jake Alexander and Brenner Avenue, not far from the Civic Apartments.
Not long thereafter, police found a car matching the description of the suspect vehicle in the apartment complex.
Accompanied by a deputy from the Rowan County Sheriff's Office, police officers approached the door of the apartment to inquire about the vehicle that was parked out front.
When officers knocked on the front door, a male exited through the back door. An officer who was stationed at the rear of the apartment spoke to the man, who then ran around the side of the building toward the front.
That's where he confronted the three officers and the shooting ensued.
Wilhelm said he wasn't sure how far his officers were from the suspect when they were fired upon, but said "It was not a long distance."
He said he wouldn't release the name of the dead man until family members were notified. Wilhelm said it would be at least today before the officers involved in the shooting were identified.
They have all been placed on leave while the shooting is investigated by agents with the State Bureau of Investigation.
Following the shooting, members of the Salisbury Fire Department and Rowan County Emergency Medical Service were summoned and pronounced the man dead.
"It's bad that a person that young chose to do what he did that ended his life," Wilhelm said.
People at the apartments would say little about the incident Sunday afternoon. Some said they heard nothing.
"We slept through the whole thing. All we know is someone got shot," said one resident who didn't want to give her name because, she said, she didn't know what was true. "I just have heard so many different stories. It's surprising because it's so quiet down here most of the time."
She said investigators "were up on the roofs earlier." She thought they might be looking for ricocheted bullets.
A man who said he doesn't live in the apartments and also declined to give his name said, "All I heard was four other guys tried to rob someone."
Wilhelm said the woman who was robbed at Rushco left before officers arrived. Wilhelm said officers were trying to locate the woman and had leads as to her identity.
He said they would like for the woman to contact police.
Wilhelm said he didn't know what became of the other three men in the Camry. A search for them continues.
Sunday's shooting marks the first time since the fall of 2005 that Salisbury Police officers have shot anyone. In that previous shooting, officers had staked out the Dollar General store on Statesville Boulevard following a rash of area robberies.
When a trio of robbers exited the Dollar General, they were confronted by officers. One of the robbers was shot. All have been caught and sentenced to long prison terms for their crime spree.

FUNNY - ALL the information given has said he had a gun - and also that he fired it - even the REAL WITNESSES stated in several newspaper articles that he fired at the cops first. and FUNNY - how his family left out the part of him getting the pot from the girl and not robbing her- THAT would have added a lot to that GREAT video.

PLEASE DO NOT BLAME PARENTS!!! I know many people who raised their children "the right way" and they were good children till they got out of High School.Got with the "wrong" crowd and made bad choices, which was their own fault. It makes me upset to see people always make such statements as the one you have made. As I have researched, genetics have a lot to do with a child's behavior. This young man should have been at home with his 4 children and maybe he would still be here today to teach his children the "right things"!

A lot of people are angry at police because they do not know the facts. THE GUN WAS FOUND CLENCHED IN SIMMONS HAND. PERIOD. STOP THE IGNORANT RUMORS. Wait for the SBI's investigation to be complete and you will have the facts. Just because you know and love someone does not mean they didn't make a bad decision. I rarely have good things to say about the City of Salisbury, but Salisbury's police officers are professionals who take seriously their duty to protect and serve. These cops did exactly what they were trained to do. They did not need to taze the guy with the gun, or try to shoot it out of his hand, or wing him in the leg. That would have likely resulted in a cop death. All of the cops involved will be cleared of any wrongdoing. Any civil lawsuit will result in a dismissal. Alfonzo made a poor choice, and please forgive me for being so crass, but he deserved what he got. You don't point guns at cops, even when you believe it to be a nonfunctional gun. This family's interview with the Post shows the denial they live in. It's absolutely pathetic. Thank God their ignorance is NOT typical.

Not sure if anybody realizes it or not, but the young man was A KNOWN FELON who faced criminal charges on a REGULAR BASIS. He made a living breaking the law. He just happened to decide to take his criminal activites one step futher and attempt to commit murder. His aim failed him and in turn his life was ended in a hail of gun fire. There was no honor is his death. I highly doubt that 50 Cent will feature him in a rap video and I feel sure that public schools will be open on his birthday. I feel for the family but this young man made a choice. His foolishness will effect everyone involved for years to come.

It is interesting to read the perspective of pillars of the East Spencer community who like to second guess Salisbury’s policemen who courageously ended a life-threatening situation over the weekend. If this were a game of chess, we'd have a “King” posing as a “Bishop” looking for “Pawns” who are willing to be “Rooked” into believing this was the cops' fault, even though he wasn’t there. The cop who fired the successful shot would be the “Knight,” so now all we need is a good “Queen” to finish out the game.

The man broke the law, attempted to flee from the police , and when trapped pulled out a gun and fired it at the police. Everyone keeps mentioning that this man has a family well those officers he was attempting to kill have families also. They did what thay were trained to do when their lives were threatned they reacted there was no time to think about it. The death of any person is a terrible thing but this man made the decision to pull a gun and fire at the police he made a choose and payed with his life. To the person who said they should shoot him in the leg, dark night, sudden encounter with somone shooting at you that is stressful enough, the officers followed there training and aimed for center body mass.

The fact of it all is he was a criminal who had just commited a crime. When officers tried to question he shot at them. If he was innocent or had nothing to hide why did he run? Why did he shot at the police? He did not want to face jail and it was his choice. You know if you shot at any officer you are more than likely going to get shot back at regardless off race. He should have been home taking care of his family instead of out terrozing people. Yes his family will grieve but they should have tought him right from wrong.

Why did he run out the back door in the first place. Obviously he did something or had something to hide or he wouldn't have been running in the first place! A person of any race or gender that has done nothing would have gladly opened the front door and talked to the police. Mr. Simmons chose the option to RUN. I do feel for his family. I hope that this shows his friends and family members that crime does not pay if they are considering going down that path or to get off the path if they were on it with him. Most of all, I pray that his children grow up to be the polar opposite of their father! The "other way to solve this" would have been for him to accept responsibility or to have not been involved in whatever caused him TO RUN from the police. Applause for the ethnic community for speaking up against IM ME! Everyone knows that not all people of any race are like this, but it is good to hear people defend themselves in this manner! It would not have immobilized him as efficiently as the three bullets that hit body mass. That statement is so ignorant, it's like saying, "Why didn't they just shoot the gun out of his hand?" It shows that those (of all races) who expected the cops to turn taze, clip him in the leg, or turn tail, are merely making excuses. As a "Black" guy! I have a problem with any act or statementment that strikes me a being dumb! When you break the law and shoot as cops...you get what you get! Sad, but true! I hate a life was lost, that's just the harsh truth! About giving a Black person a job, so they won't rob or steal...I strongly disagree with that statement! I'm Black and have worked for years! Been laid off in the past, suffered a few plant closings, but was always able to find another! A few times I had jobs I didn't like, but I did what I had to do! Fact is, we have all races of people whom are good as gold, and those that are felons! I, like many "African American," don't want anybody to give me...or hand out anything to me! I take pride in earning things from hard work and the need to have things desired! Just because 1 or two people suggest they expect a hand-out doens't mean we're ALL that way! So stop with that "You People" crap! As we approach a close election, many get stuck on the "you people" talk, as if we all don't have the same struggles! For every lazy black person, there's a lazy hick as well! Excuse me for being realistic! Good job to the police officers, but let's not loose focus just because of what 1 or two might say!!!!

The officers were already primed to shoot, because they thought they were dealing with someone who had used a gun to rob a person. But, the first officer did not feel threatened enough use his gun as the executioner of a 'suspect'. As we witnessed during the summer, when Salisbury's Police comes to the Westside, they have a history of going 'Rambo' when an 'Andy Griffin' will suffice, and thereby becoming part of the problem. If the SBI can find an excuse, as their history shows, they will exonerate the police, because the young man cannot testify. But the greater problem is a growing distrust within our community of black officers, who come to play Rambo in the 'hood'. Surely, they lose their 'Rambo' leanings when they enter Confederate Avenue. I guess justice is just that, 'just us'.

I have a 9-5 job and go by DDS every day and to the person with the kleenex comments, I see Whites just as quick blacks standing outside. I worked with a sweet white woman, that would not take the full time hours just so that her medicaid and food stamps didn't get cut off and she had no shame in her game. So its not just our race that try to stuff the system. IM ME you should never look at lack of opportunities for our race, but look more at the strength of our ancestors that made it possible to be freed. Don't let the color of your skin be the focus of not being successful. "Your kind". And to the person speaking of the United Negro College fund, baby that was by establishment by Frederick Douglass Patterson, American educator and prominent black leader in 1944 so if you want a UCCF you may need to start that one yourself. IM ME be proud of your ancestors. The stood as one and so will we. I am a single BLACK mother that has sent 2 children to top state colleges that was done through academic not sports as some feel will only be our doors for change.

Great job Salisbury Police Department. How many people would this felon have robbed or killed in the future? People, who use guns to rob, take a chance of someone getting shot, including him. Is this the first time this felon has done this? Most likely not. Did he have a job, go to school, did he do good while in school? Something to think about. Did he sell drugs or was he in a gang? Felons, who sell or use drugs, also rob people. If being chased, they run to family and other drug users or sellers who will take care of the gun or any drugs the felon has on them. NC should give black people jobs? Since when is does the state have to give jobs to people who won't make the effort to pursue jobs and make a better life for themselves. There is plenty of funding available for these folks to further their education. There are many grants and loans available including UNiCF (United Negro College Fund). There is no United Caucasion College Fund is there? Anyone with a desire to have a good life has the resources available to make their lives better. They just need to make the effort to do it. Stop pointing the blame at law enforcement for doing their job. He made the choice to do what he did and now the end result is a tragic.

This commentary is the sort that gives black a bad name. The state should give you a job? Blacks have more opportunity than others to get an education at very low costs or even free. It's sad that some don't take up these opportunities..they choose to rob and steal to make a living.

Robbery or not, he's still the one who pulled a gun and shot at police officers. If he hadn't have done that, he'd still be alive. If he hand't have run, he'd still be alive. I'm sorry for the pain you're feeling over your loss, but don't blame officers for the stupid choices he made. As for "North Carolina GIVING black people jobs," there's plenty of people of ALL colors needing jobs as well.

Al fired 5 shots at the cops, and one officer heard the bullet whiz by his head, so he was firing on the cops. He was asking for an exit plan from this earth by shooting at cops, too. Further, eye witnesses who saw him shoot at the cops gave statements that he'd shot at other people before, and that his family members had warned him that his little gun was going to get him killed sooner or later. But what I find more disturbing is your assertion, "If North Carolina give us Black people jobs then our kind will not have to get caught up in robberies." It makes me think that this comment was posted by a fanatical rightwing racist who wants to paint African Americans in the worst possible light, because I can't imagine anyone saying that if the government doesn't give them a job, then they'll resort to robbery to sustain themselves. I happen to know that the African Americans I know are hard-working people who don't expect the government to give them a job. They work because they have families to support, and because they are proud people with a proud tradition of being good community citizens. Thus, the person posting as "IM ME" is either a hoaxter, or if you are who you say you are, you need to get connected with the proud tradition of African Americans who constitute the vast majority of LAW-ABIDING CITIZENS.

The people who say the cops are not justified in shooting this man are ignorant. This man shot at the officers FIRST, with no regard for their lives (or any bystanders for that matter)whatsoever. They shot back at him to save their own lives. People need to realize that members of the Salisbury police department put their own lives at risk for ordinary citizens everyday. They DO NOT want to shoot anyone, but are put in very stressful situations where they have no choice. It it were not for a criminal running from the inevitable, this would not have happened. Let the police do their jobs. They deserve respect.

First off let me say how unfortunate it is for any outcome to result in a death, on either side of the law. Secondly, I don’t agree with commenting on an incident before the investigation has been complete. However, there are just some things I’d like to say. Fact #1 – It is against the law in NC for anyone under age 21 to possess a handgun. Fact #2 – It is against the law in NC for anyone to commit armed robbery. Fact #3 – It is against the law in NC for any to point or fire a gun at someone else unless your life is in danger. (Being chased by the Police does not justify life endangerment) Fact #4 - Once you make the decision to disobey the law, you GIVE UP your rights. Fact #5 – Had the Police not been shot at, they would not have had to RETURN fire. Why is it do you think Police offers carry guns? It’s not so they can randomly shoot people when they get bored. Their guns are there to protect themselves and the law abiding citizens. Additionally the Police are trained to know what is behind their targets so that innocent people don’t get hurt. Do you think the victim in this case cared what he hit when he was shooting at the Police? What if a stray bullet had hit someone else, like a child, or another person, or YOU! The Police are trained to make split second decisions, and deadly force is a LAST resort. But what choice did they have? They were being shot at! Put yourself in their shoes. If you were a Police Officer and someone was shooting at you, what you do? Again, the outcome for everybody involved is unfortunate. I’m sure the officers involved are not pleased with the outcome. Those officers have to live with this the rest of their lives, and they will have to think about it every single day. But to make statements that the Salisbury PD didn’t have the right to use that much force is just absurd. To the officers involved and officers across the country, thank you for keeping us safe! We appreciate what you do!

I hate that someone lost there life in a situation like this, I'm glad it was the criminal and not an officer. Lisa Watts if he hadn't shot at the cops with a gun he wouldn't have died this way. What were they supposed to do? I guess they were supposed to get in there cars and leave and let him go on his way.

Some one extremely close to me was part of this Sunday morning. All I have to say is, No, the way he died was terrible, but you know, he did attempt to rob someone and then he was shooting at the police. What were they supposed to do, just stand there. What are you people thinking, they were doing their job, protecting everyone else. Would you want someone like this loose on the streets? I sure don't!! Give the Salisbury PD and Sheriff's Dept their due, they did what they are trained to do. Teach you kids that cops are there to help and this wouldn't happen. All he had to do was surrender, was that too much to ask. Don't blame the police, look at the other person, he is the one who caused all of it!!! I will be praying for everyone involved.

seems everytime something like this happens, Salisbury Post wont give out the names, BUT Charlotte Observer has it. and why do people say, He didnt deserve to die. WELL, IF he wasnt shooting at Officers, then he wouldnt have to die! He chose that life style, no one forced this man into robbing someone. I am glad we have Officers out there that are helping people stay safe!
