If Alstin Vanderford and five other east Rowan friends ever go to trial in the death of a scooter rider, his attorney says prosecutors should not be able to talk about Vanderford's Myspace page and his references to drinking and partying.
Salisbury Attorney James Davis has filed a motion asking the judge in the pending manslaughter case to prohibit prosecutors from mentioning the social networking Web site and any witnesses from testifying about the site.
In another motion, Davis also asks the judge to bar references to Vanderford's previous court record.
Davis and Darrin Jordan, the attorney for codefendant Eric Taylor, have filed extensive motions asking prosecutors to disclose all evidence against their clients, including wreck, autopsy and toxicology reports.
Vanderford and Taylor, both 21, are two of six charged with involuntary manslaughter in the death of Michael Jason Brown. The other defendants are Brandon Lowery, 23, Patsy Morgan, 21, Rachel Miller, 21, and Derek Talbert, 23.
If convicted as charged, the six could get as much as 10 years in prison, according to court documents. In June, District Attorney Bill Kenerly filed a plea agreement he has reached with defendants Miller, Morgan and Talbert, to dismiss or reduce their charges in exchange for their testimony against Vanderford, Taylor and Lowery.
In statements filed this month in court, Vanderford, Taylor and Lowery told Sheriff's Office investigators the six friends were riding together about 2 a.m. May 12, 2006, when some of those in a vehicle threw eggs at Brown, 27, who was riding a motorized scooter along U.S. 52 between Rockwell and Granite Quarry. The scooter and the group's sport utility vehicle collided, and the group in the SUV drove away. Brown died at the scene.
In statements given to Sheriff's Office investigators, Vanderford, Taylor and Lowery admitted drinking that night.
No statements that Morgan, Miller or Talbert gave sheriff's investigators have been placed in court files.
In a motion filed this month, attorney Davis said the state may try to include information about Vanderford's Myspace page that had references like "two tattoos," "beer pong champion," "beer drinkers make better lovers (a license plate appearance)," "partying" among other images and words.
He said such images and words are excessively prejudicial, irrelevant and "improperly arouses a jury's emotional responses."
District Attorney Bill Kenerly made reference to Myspace in at least one other trial. During the 2007 trial of Christopher Crocker, who was charged with taking police on a high-speed car chase and causing a wreck that killed a Salisbury woman, Kenerly asked a psychologist if he'd looked at the teen's Myspace page.
In another motion, Davis wants Vanderford's record kept out of any trial. He said the record should not be used to call his client's integrity into question.
According to the document, Vanderford received a prayer for judgment in 2004 when he was convicted of ethnic intimidation, a misdemeanor. In that highly publicized case, Vanderford and three other teens, none of whom is involved in Brown's death, threw water on a Wendy's clerk at the drive-through window. The teens videotaped themselves and directed racial slurs toward the young woman employee, who was black.
In October 2006, Vanderford was convicted of underage possession of a malt beverage, also a misdemeanor. He received a prayer for judgment in Cabarrus County.
"... The defendant prays the court to preclude the state from introducing, questioning or mentioning the above charges ...," the motion says.
In another motion filed this month, Davis asks the judge to prohibit any testimony or argument before jurors about Brown being egged.
"... There is no evidence that either the deceased or his Moped were struck by any eggs thrown by any of the co-defendants herein," the documents shows.
Davis wants to be allowed to introduce evidence that could show the wreck was caused by the victim. He wants to include Brown's previous convictions for driving while impaired and possessing an open container in the passenger area.
Brown's death was originally classified as accidental, but the Rowan County Sheriff's Office reopened the case and got permission to exhume Brown's body.
Notes provided in the court file indicate the medical examiner who examined Brown's exhumed body states the color change in Brown's liver indicates he was still drinking.
In another motion filed recently, Jordan, Taylor's attorney, requested a hearing prior to the prosecutor introducing any expert witnesses. Jordan argues that most conclusions about the wreck were reached at least six months after it occurred and would be "speculative." He says those conclusions don't take into consideration if Brown, the scooter rider, was impaired and simply lost control of the scooter.
There has not been any indication from any interviews or reports that Brown was impaired.
- An autopsy and toxicology report. The autopsy was performed in January 2007. He said he asked for the autopsy information twice by letter and once during a court hearing.
- Any statements made by Taylor or the other co-defendants, investigator's notes and test results.
- Specific charges Morgan, Miller and Talbert will likely face if the District Attorney's Office proceeds with the plea agreement with defendants Miller, Morgan and Talbert.
"Specific information is needed to prepare for cross examination of said co-defendants so that the defendants may provide the jury ... a comparison of the punishments the co-defendants considered in deciding whether to testify for the state," the motion said.
He also asked for a 55-page report from the N.C. Highway Patrol's collision reconstruction unit of the May 12, 2006, accident.
Salisbury attorney James Randolph is representing Lowery.
The trial is set for Aug. 18.

These motions being made by Mr. Davis are ridiculous. First of all, myspace is a public website, if Vanderford's page is public it should be able to be used, he's a grown person he knows what he is putting up on that site. Also, his previous record should be shown to the court. It boils my blood that there is still so much racism in the world and even more so when you look at Vanderford's previous record and how he humiliated the young woman. This young man as well as the other 5 should all be held responsible for their actions. This is not a case of kids doing stupid things, this is a case where 6 young adults killed a man, forget the eggs and the drinking, they killed this man. They are al at fault for leaving the scene and their reported actions in the car. I honestly hope that justice is served the way it should be and they are put behind bars.

To those who are casting stones at James Davis, he is not just a fine attorney, but a respectable Christian man. Just because his client is not a well-liked member of the community is no good reason to take it out on Mr. Davis. If I or a member of my family were accused of wrongdoing, Mr. Davis is perhaps the first attorney I would contact. As far as scumbags, even the lowest form of human life has the right to due process, and legally is deemed innocent until proven otherwise. Contrary to the ignorance posted on this story, those 6 kids, regardless of what low-lifes we might think them to be, do NOT have to prove their innocence. It is the prosecution which must prove their guilt beyond a reasonable doubt. You're entitled to your opinion of their character, their privilege, their prior records, and even their guilt or innocence. But the latter must be determined by a jury of their peers when that trial begins on August 18th. Hopefully, all concerned will be able to get a fair and impartial jury who will pledge to listen to all the facts presented at trial. And those who are found guilty will be dealt with according to the law. Would you want anything less, if you were one of the accused? Or if you were the family of the victim?

I know the Vanderford family kinda well. It really seems to me and my family that the 3 people in this case that are saying that they are not guilty by not taking a plea are being treated like the walked up and put a gun to this poor man's head. So should they have taken a plea like the others and lie just to continue school and carry on as if they were not to blame, just as much as everyone in that jeep? I think that Alstin is being picked on because out of all of these kid's he was looked up to more than anyone of them. Even with problems in the past he took his punishment and worked past that part of his life. He was a kid's, he's wasn't perfect and neither is the person writing all of this trash about him. Seems to me she has an AX to grind, maybe she should take it out of Alstin's back!

I am sick of hearing about this. I go to church every Sunday, and I have prayed for Mr. Brown, but more and more I am praying for these young people. As far as Vanderford and whatever stupid things he is doing on myspace, why is that automatically Taylor and Lowery's fault? I haven't saw one bit of evidence that these two are "living it up". The fact that three are walking, and Talbert is obviously equal in whatever happened with the eggs, I find it disgusting. If you had nothing better to do the other day (like me) and read their statements, the only one that looked really sorry was Lowrey, and you also don't hear anything from his attorney like you do Taylor and Vanderford. I know six were there, but if you aren't gong to have 100% equal circumstances for the 5 passengers, and something different for the ONLY one in control of what the car actually did, then that seems so UnAmerican. This thing just seems very one sided. I think the District attorney's office just needs to figure out who is truly sorry and who isn't (if any) and punish accordingly. The family of Mr. Brown and these young people need to find some peace and forgiveness (Mr.Brown's of these 6 people) and the kids need to find forgiveness of themselves, and move forward toward some kind of healing. This newspaper doesn't care how much any of these families suffer.

First of all I have to agree with a previous poster that certain kids can get away with anything at East. There is an attitude in the East Rowan area among many of the staff and parents of athetes that these kids are above the rules. On another note, I understand that the driver of the moped had been drinking heavily on the night of the accident, so he could have simply lost control. Hopefully the truth will come out at the trial. Oh yes, I almost forgot, defense lawyers never cease to amaze me, talk about sleaze.

I can't help but wonder about these teens soul. I am applaud that these six so called upstanding teens, could lay their head down to sleep every night for 2 years and not say a word. But God will judge them for that. But because of their action there is a little boy that won't ever have a daddy to teach him to hunt, fish, and play baseball. To kiss him goodnight. Is this fair ? I think not ! All six should pay for there part. I think if it was your son, brother,uncle or father you would want justice also. In my opinion, all of the evidence involving Myspace as well as Vanderford's previous prayer's for judgement should all be brought back...The only one that should be able to receive the manslaughter is Taylor (the driver) if he actually swirved into the Moped's lane, as well as hit and run. Vanderford's prayer's for judgement should be brought back as well as the egging, the underage drinking, and not coming forward about the incident. As far as the other four, they should receive drinking charges if they were underage, egging if they took part in it, and all of them should get charged with not coming forward about the incident.

I used to work at East Rowan High and I can tell you that most of the young adults involved in this case have always felt that rules applied to everyone else and not to them. They were "Special" and now I see the lawyers are wanting us to feel the same way. Sorry, but they are not in high school anymore and its time to grow up and pay for their crime. I know that some will just get community service, but I hope they have to do something where they have to get their hands dirty and maybe humbled a little. They need to see that they are no better than anyone else!

I think it is a bunch of bull that they want it kept out of court. If the kids had not wanted people to see what they were doing then they would not have posted it online. They knew people could view it and that could come back to haunt them. I know people make mistakes, but you have to learn from them not run from them as the "Children" did. I hope Michael's family gets some closure soon and that the courts don't drag this out any longer than it has.

They are all kids and yes they did some STUPID things in the past but don't we all? We don't know what went on that evening and will only find out once this goes to trial. Right now it is all he said, she said. This was a horrible "accident" !! I'm sure they did not go out to purposely kill someone. That is the most ridiculous request that could be made when they want Mr. Brown's records brought into court. These young people were out for a joy ride and some if not all had been drinking of which they told the investigators. They admitted throwing eggs at the person on the moped and turning around to do it again. Also, do you honestly think someone on a moped would delibertly aim the moped at an SUV, please think again. Also, Vanderford said "I hope he dies then he can't talk", folks that tells me all I need to know, they hit the man and did not even think once about helping him. I am sure if they would have confessed to what had happened they would have been given very light sentences and people would have respected them much more and forgiven them as our God will do should they ask forgiveness. They have brought this blight upon themselves and in the mean time caused a lot of suffering to many innocent poeple; the Brown's; their parents; family and friends. They must suffer the consequences of their deeds. We only live once and it is very sad to lose a loved one and especailly in such a callous manner. It is about time Vanderford and others grow up and quit playing these childish games and realize there is a "real" purpose in life and it isn't partying all the time.

When you make a mistake you pay for it, when you go to a site like MY SPACE and post you do so at your own risk, it is pubically accesiable. You break a law and it's public record. A mistake was made a man is dead and it doesn't matter what kind of man you think he was, our society doesn't and shouldn't distinguish between people when it comes to the accepatabilty of crimes against a person. This isn't hard to figure out,someone is dead, someone (some people) are responsible. Go to court present all the evidence and let jury decide.

Each one made a decision to NOT call 911 and try to help him at all! Now to my point . Why bother calling the police when something happens around you when they do NOTHING. No matter whether Michael was still drinking or not, the fact still remains that these 6 intended to egg him when he was minding his own business and had plenty of time to stop their vehicle instead of continuing to drive toward him and hit him. Sorry Davis, there is proof that they hit him, their own statements...all 6 of them admitted it in their statements. Their statements didn't read as "foggy" to me or anyone else but you! Davis must be worried that he and his client will lose in court since he wants so much evidence suppressed! Vanderford's family must be paying you some big bucks to have as little concience as the 6 of these young adults do! I forgot, you paid enough to go through law school to get rid of your concience!

sounds like the lawyers for these kids are making out Brown caused his on death! yea, lets throw the blame on a guy that cant defend himself and tell what REALLY happened! come on, those kids knew what they were doing, ALL of them! and saying: There is no evidence that either the deceased or his Moped were struck by any eggs..Well Duh, I dont think the police were looking for eggs with a man laying on side of road hurt bad! Davis wants to be allowed to introduce evidence that could show the wreck was caused by the victim, yea right, throw ALL the blame on a guy that isnt here to tell anything just to let these guys get away with another crime and a slap on the wrist! guess thats what is wrong with the systems!

they want to make sure everyone hears all about anything bad the victim has ever done, but don't want it revealed that they are representing habitual troublemakers. how DO they sleep at night?
