Grand jury indicts two charged in death of scooter rider
E-mail to a friendspotts@salisburypost.com A Rowan County grand jury has indicted two of six people charged with involuntary manslaughter in the 2006 death of a motorized scooter rider. Brandon Heathcliff Lowery, 23, of 165 Johnson Dairy Road, Rockwell, and Alstin Lee Vanderford, 21, of 418 Gold Hill Ave., Rockwell, were each indicted July 7 on a charge of felony aiding and abetting felonious hit and run/failure to remain at the scene. The two, along with Patsy Elizabeth Morgan, 21, Rachel Ann Miller, 21, Derek Ryan Talbert, 23, and Eric Gregory Taylor, 21, are charged in the death of 27-year-old Michael Jason Brown in eastern Rowan County in May 2006. The six are also charged with fleeing the scene of an accident. The Rowan County Sheriff's Office served Lowery and Vanderford with orders for arrest that were issued Tuesday. Lowery and Vanderford were each given a $5,000 bond, which was continued under their current bond. All six were given an initial $5,000 bond when charged in 2007. Brown was initially thought to have wrecked his scooter accidentally. A report from the N.C. Highway Patrol confirmed his scooter crossed the center line and overturned. His body was exhumed in January 2007 after new information prompted authorities to reopen the case. The teens turned themselves in to authorities in early February 2007. Lowery and Vanderford are expected to appear in court during the next term of Superior Court. Related

Are you people really arguing online about people (which of whom most of) you don't know. For all of you talking about the corrupt system, why don't you go to law school and become our new District Attorney, or even become one of our next judges. Making judgments without 100% of the facts is about as wise as reading a gossip column and believing everything it says. Reading these comments just proves the ignorance that overwhelms Salisbury and Rowan County; so why don't we all just be quiet and see how the court settles this?

These kids need to own up to what they did and stop the pity party!!!!! The PITY is for two little boys that will never get to feel the touch of the fathers hand EVER again. Michael want be there for his son's win they get there first car, go on there first date, get married , or all of there school activities. These little boy's will NEVER EVER here there father's voice or hug him again!!! This is where the pity need's to be not on six MURDERER'S. What does Dr. Boyd's case have to do with this ???? Again the PUBLIC need's to DEMAND JUSTICE for the Brown family!!!! If they get away with MURDER what's next? If I hit someone by accident I would call for help right away , not wait until someone told on me. As far as God being the only one who can determine a man's death, which one of these "fine young adults," that did not tell anyone what they had done for years and did not bother to stop, or even call 911 on the run, is God? Think before you speak. This is for all you good East Rowan folks that are saying it wasn't intentional, it was an accident, well these "good kids" intentionally left Michael Brown on the side of the road to die.

People say "how would you feel if you were the parent of one of these kids and you had to read this..." Well, put yourself in Mr. Brown's parents shoes. Ask yourself that. Big deal?- these kids were popular and their parents have money and they will probably get off easy but, they killed a man. Intintional or not, they taunted him and hit him and then let him lay there and die. I know what happened and they aren't my friends anymore and they should all be put away. These individuals intentionally threw eggs at and hit a man with their vehicle and left the scene. They left the scene because they had existing records, they said it themselves. A mistake? I think not. Do they deserve the death penalty? Probably not. However, that does not make what they did any better. Those of you who "know" these people, it’s obvious that you’ve been fooled. You claim you know them and have for a long time. Did you ever think they were capable of such atrocities? Probably not, but that doesn't make what they did any better. Regardless of who they were growing up, this is who they are now, and it's not all that great. These children, and they are children, have done what the law deems a crime, a felony, the worst possible charge. Their immaturity is evident through their words, their actions, their accusations and blame placing on people they once claimed to be their 'friends.' God knows everything, sees everything, and he forgives. But he also put us on this earth, not to kill each other, but to take care of each other. Thankfully we have a justice system that doesn't forgive, but punishes those who do wrong. I only pray that teens AND PARENTS today take note of these individuals and see how serious this is, that they realize and know right from wrong. Obviously something not all of us learned growing up!

I have lived in Eastern Rowan county all my life and I DO have a clue to the family lives of these kids. So for the sake of saving a arguement, let's call them advantaged. They don't want for anything. Perhaps Mr/Mrs writer is a family member or family friend, defending the little angels. I challenge you to pretend you are Mr Brown's parent or sibling or family friend. Me doubts that your feelings towards the brats would be the same. But if you think for one minute, bullying didn't play a role in this tragedy, you are a bigger moron than I sir/maam. They targeted Mr. Brown as a defenseless "moped driver" and attacked him. No, they didn't "mean" to kill him. They just wanted to hurt him with a hard thrown egg to the head and/or body...to humiliate him...perhaps embarrass him...to show Mr. Brown that they were better and more powerful than him! Two of them have been let go for a crime before with a slap on the wrist and see now what the have learned? If you are still friends with any of the 6 involved, if I were you I think I would consider removing them from my "friend" list. You can see where 2 (charged so far) can get many others in trouble when they are nothing but trouble. As far as the parents reading what is written about their "kids"....not really worried about it. THEY KILLED A MAN!!!!! They may not have set out to do it but they ended up doing it, that is a FACT you can count on! Had they not been drinking and UNDERAGE I might add (by the way, where did the beer come from?) they may not have even been out trying to pull this simple little prank that everyone of their "friends" keep refering to. These young adults have had 2 years to get their "friends" to come to their aid and paint a pretty picture of them. Forget it, most see it the same way...put them all away! You want truth? Here it is, your friends were out doing something illegal to begin with, ended up killing a man, covered it up for 6 months, Michael is laying in a cemetary! Need anymore proof? They all admitted to knowing what happened, it's all in black and white for the public to read. Get some new friends before you end up in the "wrong place at the right time" with them if they get off! Most responsible people (even young adults) would have the decency to get Michael help if it were an accident.

Everyone just believes what they hear instead of what is the truth. I just wish that everyone would keep their opinions to themselves rather than bashing these six. How would you feel if you were the parent of one of these kids and had to read this? It wouldn’t be a pleasant feeling, especially when their kid is the one that is being bashed. Yes; I am good friends with many of these teens and yes I am very close to one of them and it hurts me to read all of these harsh comments. Especially the ones about the death penalty and referring it to the Dr. Boyd case. So before you go pointing your fingers at them, make sure your own hands are clean. Why don’t all of you sit there and think of a time when you were in the wrong place at the right time…exactly, each and everyone one of you probably thought of a time; it’s only human. I mean seriously, you are making it out as if these teens went out and tried to kill someone. I know for a fact that isn’t what happened. And for those to say stop judging people do it every day with every other case or situation that comes through this small town. i hate that it happens b/c we should judge nobody. But you cannot say these kids are innocent and they did something stupid. they did make a mistake and were acting like fools but it was worse when they just left this man after causing him to wreck no matter what they did to him they didn't take the part of bein a good citizen and atleast callin an ambluance. i feel the these families well some of them. some raised there sons to look picture perfect just as they like to look perfect but instead they are full of evil. I know that good Lord has something in store for each of these kids and the Family of an innocent by-stander.

Particularly those with prior records. Just give them at least a year in prison---they will learn about being bullied, instead of dishing it out. The ones with the "ethnic intimidation" on their records won't make it a year in prison, because the inmates themselves with see that "justice" is served.

All of us are morons??? : Wednesday, July 16, 2008 6:08 PMLet me just start with the fact that I posted 6th up from the bottom, and I am a relative of Michael Brown. I can tell you right now that the entire family wants justice! For some of you to run to these "kids" defense is absurd to say the least. In the reports they all admited to drinking, buying eggs, egging houses, throwing eggs at Michael and some of them already having records. Do not tell me not to judge people that were involved with someones death that was out looking for trouble to begin with. These are/were not "kids" that were out pulling pranks, that would have ended with egging someone's house. Yet they were intoxicated underage and out driving. An error in judgement...I think so, a big one. I really don't care what these young adults have to live with for the rest of their lives due to their stupidity, they will get over it long before this family ever does. They have their loved ones, we don't. Some of you need to learn what "poor judgement" and "accident" is! There was no "accident" to this! If they had not turned around to go back and throw the second round of eggs, the first round would be considered "poor judgement". These young adults all admit that they went back to throw the second round and he was hit and killed...they sat there in the middle of the road for 10-15 seconds for Gods sake. Not one of these 6 fools bothered to get out and check on him, just left him for dead. Don't tell me they were young and "freaked out" at what had happened and didn't know what to do. If they were such "good kids" like some of you make them out to be at least one of them would have gotten out of that jeep to see what they had hit, they knew they hit him. Why in the world would they take another car back to the scene if they didn't think they had hit him and harmed him at the very least. Why didn't they drive the original vehicle back to the scene? They knew exactly what they had done when it happened or they wouldn't have wanted to get everybody back to the house so quick. IF they were such "good kids", they wouldn't have tried to cover it up. "Good kids" do not continuesly get caught doing things and not learn from their mistakes the first time! I don't know that I can honestly say they deserve the death penalty, but I can say I would like to see all of them behind bars for the rest of MY life if not theirs! This is not the Middle East where we go out and hang people, but I do know if there were stiffer penalties to pay for crimes (and yes MAYBE even going back to hanging) there would be a lot less crime and a lot less people in prison! We are not talking about 1-15 year old kids here, we are talking about 17 and up...YOUNG ADULTS! Try them as such, not as minors. They should have never been allowed to be out walking around enjoying life, and they must have been if one of them was at the beach within the past two years telling a friend "how bad they felt". Also everyone needs to get their facts straight, it's easy to blame everything on Taylor and Vanderford, what easy targets. However, if you must know it was Lowery in the front seat and Vanderford, Talbert, Morgan, and Miller in the backseat. Vanderford wasn't even on the correct side to be throwing eggs so ponder that for a minute. They are all equally responsible for anything that happened that night, but no one knows except for them the details so stop talking about these rumors as if its fact. His head was NOT ran over. In fact HE was not ran over, as was found by the medical examiner when his body was exhumed. He died from a neck injury that is common when a person flips the scooter over and falls forward. Also, everyone is talking about Vanderford's prior incident but what about Talbert's multiple DUIs, etc. I guess its easy to squosh those crimes when your family is in the legal system....Get your facts and stop your judging and ridiculous allegations!!!!!!!!!!

The death penalty, really? These comments are ridiculous and no one knows what they are even talking about, the fact that yall dont even know who was sitting where or who threw the eggs is obvious by your absurd allegations of the truth. Hell, the kids' ages (I'm assuming as reported by the Post) aren't even correct, so it shows what kind of reporting our paper is notorious for. It's funy how easily people can judge others when no one really knows what they'd do in a similar situation until it actually happens. Everyone needs to learn their facts before passing judgement, and I don't suggest doing so by reading the Salisbury Post. Furthermore, there were not only 2 passengers, yet it seems that only two are being tried here for felonies. I realize that certain people have certain connections that allow this to happen, but it is extremely unfair. All of the passengers should be tried the same and receieve the same penalties, yet some continue to go on with their lives as if nothing happened will others' lives will be forever changed. Past incidences are of no relevance to this case. I just hope that justice can be served in a fair manner, which in and of itself is unlikely in today's court system. In the meantime, keep negative comments that have no foundation out of public domain.

These young poeple are so spoiled rotten and have nor been taught the value of life and respect for other people by their parents. Vanderford was involved with another group who pulled up to the drive-thru window at Wendy's and threw water on the young Afro-American girl who was there to take their order. The prayer for judement he received after she and her parents were so kind to him in court should be rescinded. He still has not learned a "darn" thing. Throw the book at him this time, Mr. Kenerly. These are supposedly young poeple from good up-standing families but they are only young "punks" who have nothing better to do than assault others and go on there merry way. Where is the "humbleness and forgiveness" they should be begging for from the family of the young Brown man. His family has been devestated and are not able to share their feelings of love with him in this lifetime. May God help this family to at least have closure soon in this "horrible" siuation.

First they all knew they were going to get eggs to egg someones house (breaking the law), when they seen the guy they threw eggs at him and then TURNED AROUND FOR MORE). Why did they turn around, to hit him with some more. Then when they swerved to avoid him (funny thing if they would have swerved the other way they would have avoided him. But, no one called the police (Breaking the law), then they left the scene(Breaking the law), then they all went back to a safe haven and didn't do anything (Breaking the law). The three of you that went to see if he was okay (were you really concerned or just scared), you just let the ambulance take him away (Breaking the law). WOW!! How many times did they ALL BREAK THE LAW? Now, lets see should they be let off for BREAKING THE LAW? NO Definetly NOT. Of course the two got slapped on the hand the last time they got in trouble at Wendy's. Wow, they figured well we got off that time, we can get off of this one. Killing is a sin. Maybe if we quit slapping these criminals on the hands, they will get the point and serve their time and STAY OUT OF TROUBLE.

What that means is you can be charged for a crime just by being an assesory to the crime. He should have not been with them if they were up to no good. When they hit him, it startled him, then he laid the bike over with no time to avoid him. I agree they should be punished, but the death penalty. A man can go out and rape and kill someone, and you morons would say "oh just put him away for a while." I agree they should be punished, but you obviously don't know the law. Since Vanderford received a prayer for judgement in the Wendy's incident, that will be brought back into the picture. They'll pay restitution and serve a light sentence and community service, then probation. It's our court system, not the middle east where you go and hang someone.

They were taunting him and throwing eggs at him and then they turned around and did it again until he wrecked and then they ran over his head. If they would've called the cops when it happened, he might still be alive. They are all guilty and reguardless of who was driving, not one of them said anything to the police or called an ambulance when it happened. They all turned themselves in AFTER they got caught. Call it what you want but if it was your family member that was dead, you wouldn't be feeling for them or making any excuses for what they did.

Past incidences are of no relevance to this case. I just hope that justice can be served in a fair manner, which in and of itself is unlikely in today's court system. In the meantime, keep negative comments that have no foundation out of public domain.

I went to school with them and they were just like everyone else. Had a good time but made mistakes. If any of you think you havent done something stupid you are WRONG! Yea what they did took someones life...but do you honestly think they woke up that morning and said, "I think Ill take someones life today." NO...they were out being stupid-throwing eggs-which I may add is VERY immature-but never did they ever think it would kill someone. Everyone needs to quit judging them and start judging themselves. No one is perfect-they just made a huge mistake, that I am positive they would all take back. You dont know these kids or their hearts, so quit looking at them as evil.
Report Abuse: Wednesday, July 16, 2008 10:34 AM Eric was driving, Vanderford was in the passenger seat throwing eggs. The other 4 were in the back, riding! Eric and Alstin committed the crime, but yet you all look at the other 4 with a terrible opinion. I know Talbert and Lowery have regreted ever hanging out with Eric and Vanderford. I went on vacation with Lowery and he admitted how terrible he felt. As he said, the 4 in the back didn't know what to do. They never want to see a friend in trouble. After they realized what they had done, they returned to the scene where police and ambulances had already arrived. Then they really paniced. Don't judge the other 4. They have been truely traumatized since this.

The situation was that they had a total disregard for anyone, throwing anything out of a car at someone is a malicious act with intent on doing harm, if they all participated they were more than just passengers, even worse they left him on the side of the road not knowing how badly he was hurt. I guess you want the family of Mr. Brown to say its okay and you just made a horrible error in judgment. Try to think of how you would feel if they had done that to someone you love.
Report Abuse: Wednesday, July 16, 2008 9:03 AM The Vanderford guy is known as a bully. With all this on his record he hasn't stopped. I recently observed him threating someone at a ball game. With all he and his family are doing to paint a picture of how he is a great guy the spots on this cat haven't changed. Going back to the water throwing and if the egg throwing is true it just shows this guys state of mind. I don't know what is in his heart but his actions show he feels as if he is above others and has no regards for the rights of others.

I hate to see that they have made an extreme error in their lives, and they will pay for what they did. I wouldn't want anyone to think they there any different from anyone else, bc to me they are friends that are in need now. Some have lead hard lives, some have lead a great life until now; don't judge them unless you have been in their shoes. Don't you think the reason your only seeing twon indicted is bc the rest turned in evidence???!

It wasn't a mistake or accident when they left Michael Brown at the scene, IT WAS A CRIME!............It would appear so far each one is to be held accountable. Do hope justice is done (in the courts) before they pass away from old age.

Instead they got a slap on the wrist for what happened that night at Wendy’s so then they think they can get away with anything. Including throwing eggs at someone on the road. Last time it was throwing water on the person in the drive through and nothing happened. So they continue on with their pranks and now we have someone that is dead because of their pranks and our justice system not doing anything the first time around. I hope that the court system will give them ALL due time for this prank. Maybe it will save a life in the future. Maybe some teen will read the outcome of this case and think twice before doing anything like this again. They should all do some long hard time in prison and should be tired for the death penalty. Let’s put Justice back in the system.

I have grown up with most of the kids and they did make a horrible mistake and trust me - they regret it each and everyday of their lives. I happen to grow up right beside one of them and now live with them in college - and knowing "him/her" personnally and watching them go thru it - I know they just made a big mistake in their lives that will probably be with them forever but you cannot change the past. I also agree - know the whole story before making sladerous comments. No one is going to school to be an attorney. That would be small talk and Smallsbury. People always say what they hear even if they don't know the truth - which is part of the reason I now live where I go to school. Imagine raising wonderful children and they make a horrible mistake like this - would your be writing those comments. I normally keep my opinions to myself and don't write on these things - but it hurts me too...

The passengers were just passengers, threatened with their lives, and unfortunately were incapable of stopping the driver and his cohort of terror. Underage drinking by the passengers and driver played a part in this tragedy. The two males indicted are guilty as sin and isn't the first time these two males have broken the law and thought they could get away with it. Judge not ye be judged. In the end the lost of Mr. Brown's life can not be resurrected and only aggravates and in flames a wound that needs to be healed.

If the events surrounding this death were disclosed in the paper, you'd probably find they threw stuff at the poor guy they killed too. Maybe it will all come out in court.

All 6 were a part of basically a murder and were more than happy to cover it up. Obviously the parents bailed these brats out the first time so they could live their lives. Michael didn't have that option. None of the 6 have a concience, bring them all in and put them away. This was no accident! It was pure and simple premeditated, maybe not toward Michael in particular, but it was premeditated none the less. The intent may not have been murder but thats what happened, no other way to look at it. Put all involved away for a long, long time!

Secondly, these kids aren't privileged. You don't have a clue about their home situation. Secondly, the other four are not "brats", they are good kids who made a horrible error in judgement. Thirdly, this had nothing to do with bullying. These kids panicked, didn't think straight as 18 years olds often don't, and made a terrible decision. Obviously they will pay, as they should.

Kudos to DA Kennerly and law inforcement for finally bringing them to justice. My only question is, why weren't the other four brats charged? If they were in the car when they ran down Mr. Brown, and were diligent in trying to cover up the crime, they are as guilty as Lowery and Vanderford. What makes this crime so vicious is that it was a murder born of bullying. These "good" kids found a target for their bullying, and it ended up costing Mr. Brown his life.
