After the crash: Recovery slow after Cabarrus Sheriff's deputy hit motorcycle

Salisbury's Clifford Goodman hadn't ridden his new Harley-Davidson much in the spring of 2007.

On April 13 of that year, a friend asked Goodman to drive to the antique car show at Lowe's Motor Speedway. Goodman saw it as a chance to try out his new ride.

"It was a pretty day, and I hadn't had the bike long ... so I was wanting to ride it," Goodman, 47, says.

He and fiancee Cathy Wells left their home off Old Concord Road and hopped on the 2002 Harley.

In Concord, Goodman was set to turn left into the speedway's parking lot.

He remembers seeing a Cabarrus County Sheriff's cruiser at the intersection, but he couldn't have predicted what would come next.

"My fiancee said, 'He's gonna —' and she never got 'hit' out of her mouth," Goodman says. "He T-boned us. Everything went black."

Cabarrus Sheriff's Deputy Richard Measimer had been working security at the antique show. After the crash, he told Concord Police he hadn't seen the motorcycle as he pulled out of the parking lot onto Morehead Road.

The collision sent Wells flying off the bike.

"When I woke up, I was laying on the other side of the highway, and traffic was coming from everywhere," she says.

Goodman wasn't as lucky. The cruiser ran on top of the bike, and Goodman fell under the bike, his right leg crushed by the combined weight of both vehicles, Goodman says.

Measimer backed his car off the bike, but Goodman says he still couldn't move.

In the months that followed, Goodman had several surgeries to fix his shattered lower right leg.

He says bills he's accumulated since the accident, along with lingering medical problems, have thrown him into a financial mess. He says he could lose his home.

In court records, no one is disputing that Deputy Measimer was at fault in the accident. But a Concord police officer did not actually cite Measimer in his report.

And county officials have not offered any help for Goodman, requiring him to find an attorney and begin the lengthy process of suing those involved.

Goodman thinks the situation would have gone very differently if he had been driving a car and struck a motorcyle cop.

"I would have been thrown up underneath the jailhouse," he says.

He wonders why Cabarrus County officials won't treat him like they would want one of their employees treated.

No comment

Goodman says Measimer apologized to Wells the day of the accident. He told her he had never hit anyone with a car before.

That's the last he and Wells have heard from the Cabarrus County Sheriff's Office.

Wells says she suffered a concussion in the accident, and Goodman's injuries were more extensive. Rescue workers took him to Carolinas Medical Center-NorthEast.

In the first of four surgeries, doctors put pins and rods in his right leg. About a week later, they used plates and screws to reconstruct his knee.

Sometime during his hospital stays, Goodman contracted MRSA, an infection that can be deadly.

Last summer, Goodman says, doctors had to flush out the infection from his injured leg. A few months later, he says, they decided to remove the plates altogether because of the MRSA.

The surgeries have left Goodman with a long scar down the inside of his lower right leg. He also has what he describes as a flounder-shaped mass of skin and tissue on his outer right leg, where he had gotten a skin graft.

Life didn't return to normal for Goodman and Wells after the accident.

"I had to re-learn how to walk," Goodman says. "I couldn't use my right leg at all."

With a leg that was practically useless, Goodman needed a lot of help. So Wells quit her job at McDonald's to tend to her fiance.

"I was his nurse (for) about eight months," she says.

She changed the bandages on his leg and gave him shots to fight the MRSA infection. She also drove him to Charlotte regularly for doctor appointments.

Hard times

Goodman was born and raised in Rowan County.

He has been on disability since 1996 due to panic attacks. He receives $650 a month in disability payments, he says.

In the past, he has worked as an auto mechanic and a welder. Before the accident, he often fixed people's cars in his garage, earning $100 a week or so.

The money came in handy.

"That'll pay your bills and buy a few groceries," Goodman says.

But now he says his leg injuries prevent him from standing for long periods of time.

"Now I have to pay to get my own vehicles fixed 'cause I can't get down to fix them," he says.

His problems go beyond that. Although Goodman says Medicaid is taking care of his medical bills, he's in danger of losing his home.

He says he's behind on house payments, and he has been forced to go to Rowan Helping Ministries for help with the electricity bill.

Goodman and Wells recently split up. He says the accident put a big strain on their relationship. Goodman thinks things might have been different if he had been able to hire a nurse to care for him.

No help

In June 2007, Goodman's attorney, Robert Hanner, who works for a Charlotte law firm, asked Cabarrus County officials to pay $1,000 a month for an in-home nurse.

In a letter to Cabarrus County Attorney Richard Koch, Hanner said any money the county advanced for a nurse would be deducted from any future lawsuit settlement.

"We tried very hard to see if they would advance some money, at least for nursing care," Hanner said.

The county declined to give Goodman and Wells the money.

The county's role in the accident — and the lawsuit — has been up for debate. The original suit, filed in January, lists Cabarrus County as a defendant.

But Hanner said he took the county off the lawsuit because of governmental immunity — a provision in state law that basically exempts governments from civil lawsuits.

"A local government cannot be sued for the acts of its agents, its employees, when they are going about their basic duties for that government entity," Koch says.

That immunity can be waived if the government entity buys liability insurance. The waiver amounts "to the extent we have purchased insurance," Koch says.

He says Cabarrus County has some insurance but does not know how much.

The defendants' response to the lawsuit admits that Measimer was negligent in the accident.

But Concord Police, which responded to the crash, did not cite him for a traffic violation, according to police records.

In an e-mail last month, Kenneth Raynor, who is representing the defendants in the case, declined to comment since the case because of the pending suit.

In the meantime, Goodman and Wells are trying to get by. She is working again, although she says she still has dizzy spells.

Goodman is waiting to find out what happens with the lawsuit.

"Sometimes you feel like you can never catch a break," he says.

I see people are thinking that cliff paid for his harley with drug money.As his son I can vouch for him on that. He took my check for back pay child support and went and got a 2005 yamaha V-star. About a year later he traded it in for the harley-davidson (even trade) at extreme motor cycles of salisbury.All yall haters keep hatin' ,I bet if it was you that got hit you would be looking at it different.

with failure to yield the right of way! Anyone want to take a guess what would have happened if it had been Meiser that had been hit while on duty on a motorcycle by any average Joe? GUARANTEED the average Joe would have been cited. To say otherwise is blowing smoke!

I know Goodman Really well, and he is having it rough right now, its hard for him to keep food in his home, and hes worried about the bills not being paid....It doesnt matter what kind of past he has had. the d**** cop hit him and it was the cops fault, so somebody ought" to be paying up now, because its just going to cost you more in the long-run. thats pretty low that the cop or anyone from the sheriffs department hasn't even called to appologize or check on him, huh' I thought you were here to protect and serve. maybe you ought to change your slogan.

I dont know how bad the damage was to his bike after the ACCIDENT, but I know he rides a bike now. And with panic attacks what is he doing driving anything!! And as far as medicade paying the bills, why is the county not paying them seeing it was the cops fault?

I agree that Mr.Goodman needs "some" compensation for his loss and I am sure that he has been through a lot because of the accident, however, the Law Enforcement bashing is absolutly uncalled for. I understand the rights for freedom of speech and I know that every one is entitled to their own opinion but to form an opinion on a case that you only have half the story is like baking a cake with only half the ingredients. It will fall apart. Would we like it if "Law Enforcement" only got the other half the story and formed an opinion on the information that did not come out to our favor. I know at leats that I would not like it if that was the case. Law Enforcement officers always gets a bad rap, sure they are held to a higher standard than us but they are human and do make mistakes. I am sure that Mr. Goodman will be compensated for his loss and I hope he has a full recovery. So the next time you see a law enforcement officer thank them for the job they do because the life they save may be yours or one of your loved ones. Last but not least we should be thankfull that we have men and women that will put their life on the line for ours.

As a police officer, I worked many traffic accidents. No where is it required that police write a ticket to anyone at fault for an accident. If an individual admitted fault, I would write that the person admitted fault in the narrative and leave it at that. For some to call Deputy Measimer "blind and dumb" is insulting and degrading. It is no leap of faith to think that everyone has made a mistake. Driving accidents happen. As many miles as police officers drive in a a given career, it is a statistical probability that they will be in an accident. Stop with the " blind and dumb" comments! Whatever insurance issues are present, no one should believe that Deputy Measimer is at the office "laughing". In reading many of the responses, I felt that many just don't like the police. It is easy to blame law enforcement for your problems. The only problem that I feel truly exists here is that someone was involved in an accident and there is an insurance issue. How much is paid and when is a claim paid. This is the story of insurance in this country, not a story of law enforcement.

I whole-heartedly feel he deserves some compensation (note the word some), however, I find it hard to sympathize with someone who has been out of work for ten years over panic attacks (an easily treatable disorder). He's already been living off the government for ten years. Secondly, if he's about to lose his house and he can't pay his electric bill, he is more at fault for that than Cabarrus County. He has continued to receive the $650.00 "disability" payment each month. The accident didn't stop those. He had money to own and pay insurance on a motorcycle. Where is that money? Third, if Mr. Goodman is asking for an excessive amount in judgement, Cabarrus County is not going to pay anything to him. Paying him anything while he asks for an excessive amount creates the landscape for them paying not what is a fair amount, but something more punitive than they deserve to.

I dont understand how hes about to lose his home its not like hes out of work and missing paychecks. His disability checks are still coming? As a Harley owner myself that I work my butt of for I do find it shocking that the officer was not charged how can they enforce laws that they dont have to live by. The police were wrong in this case buts its hard to feel sorry for someone thats obviously playing the system.

This is terrible. I agree if it had been the other way around, Goodman would have been cited on the scene. But since it was a local law enforcement officer you know as well as many they stick together when it is one of the local law involved in something so that is why the police didn't cite the deputy even though it is clearly his fault. I hate the troubles that Goodman and the lady has had to face through this but just because it was a law man involved doesn't mean he is above the law like they all think..... My prayers are with you Goodman for strength and a great big settlement from someone for the pain and suffering you have been through and not to mention what you may go through in the future. This is a very sad real story !!!! I could only imagine what Mr. Goodman would have been charged w/ if the roles were different ! No traffic violation .... get real !!!!! I can't believe the Deputy hasn't even picked up a phone to call Mr. Goodman , let alone pay a BILL !!!! Is this human ????? Where is your hearth Mr. Deputy ??? How would you feel having to go and beg for assistance to keep your lights on ??? Or having your house taken from you ! Hopefully justice will be served and Mr. Goodman will get what is entitled to him. God will bring something good out of this horrible situation, try to stay positive. God Bless and keep you healthy and strong. Great story! Sad... but true !!!!!!

Cmon Cabarrus, man up and help this guy. Believe me, it will cost you ALOT more in the long run. One thing stands out though. What is someone on disability doing with a new Harley? Panic attacks... Maybe a little of cosmic justice here.

They don't call it the 'Thin Blue Line' for nothing. How can deputy Measimer NOT BE CITED? It is at the very least failure to yield. This is clearly a case of the Concord cops sticking together to protect one their own and the county. Goodman is exactly right, had he been driving a car and hit a motorcycle cop, the Concord Cops would have thrown the book at him, locked him up and thrown the key away. NO DOUBT! As a fellow Harley rider it is another lesson learned. Even a policeman is not to be trusted as you ride your bike. I hope things work out for Goodman.

That just shows you, that there is two set of laws'One we must go by and one the police must go by. like he said if he would have have hit the police he would still be in jail.. Sad day when county wont help help , even when the know they are in wrong. They will let this poor man lose evrything before they step up and do whats right.What comes around goes around. Maybe one day someone will be going down the road and see one of the police in need of help and just ride past them.If it was one of the police they all would be there to help even if the person hurt was in the wrong. Sad sad day.This is the kind of story that gives the police a black eye.

wondering how a person that gets $650 a month in disability and is on Medicaid, can honestly afford a 2002 Harley and the insurance on it? sorry, but I cant feel sorry for someone that sits on disability for panic attacks! they have medicine for that. nope, cant feel sorry for this guy and Didnt I read a few years back, that this guy was selling drugs and had guns and got caught? OH, Thats how he can afford a Harley!!!!

I sorry, this wreck (not accident), he DID HIT the couple, happened by law enforcement on our public streets and the local officals ought to step up to the plate and help this brother out. I could go on and on but I just want the person or persons at faught to do what is right thing! Ride Safe & Ride Often...
