Candidate's brush with law could keep her from serving on board
E-mail to a friendSalisbury Post A Rowan County Board of Commissioners candidate's 10-year-old embezzlement plea has raised questions about whether she can legally run or serve. Laura Lyerly won a spot on the Democratic ballot in the May 6 primary, collecting 6,351 votes. But it's unclear if the 29-year-old candidate will remain on the ballot in November. The local district attorney says he doesn't think Lyerly's record would prevent her from holding office, but he's awaiting an opinion from the N.C. Attorney General's Office. Lyerly did not return telephone calls or e-mails from the Post. In August 1998, authorities charged Lyerly, who was then 19 and working at K-Mart, with embezzlement. A Class of 1997 valedictorian at North Rowan High School, she was enrolled at UNC-Chapel Hill. She was apparently working a summer job at K-mart. On Oct. 20, 1998 Lyerly entered a plea of guilty to embezzlement. She received a prayer for judgment continued and paid $80 in court costs. The state Attorney General has been asked to issue an opinion as to whether the prayer for judgment is a conviction. Records of the case have been destroyed, but Lyerly has acknowledged "shoplifting" while employed at K-mart. She disclosed that fact while speaking at a forum as a candidate for the Salisbury City Council in 2007. Lyerly filed for the Board of Commissioners on Feb. 29. One of the questions on the filing paperwork is, "Have you ever been convicted of a felony?" Lyerly circled "No." If a candidate answers "Yes," to that question, the form also provides spaces to specify the offense, date of conviction and other details. Lyerly did not fill in any of those spaces. Lyerly signed the sworn statement of candidacy, which was certified and verified by Rowan County Elections Director Nancy Evans. Questions about Lyerly's brush with the legal system and status as a candidate began flying around the county immediately after the election. District Attorney Bill Kenerly said Tuesday that someone in law enforcement asked for his opinion on whether a prayer for judgment constituted a conviction. The N.C. Constitution prohibits anyone who is a convicted felon from running or serving in public office. Kenerly said that after considering the matter, he decided that it isn't a proper question for him to deal with. So he contacted the N.C. Attorney General's Office and asked for an advisory opinion. Kenerly said he was advised that it will take about a month to get an opinion from the Attorney General's Office. Kenerly said he believes that prayer for judgment is not a conviction and would not disqualify Lyerly from running and serving. "Local attorneys commonly say that it (prayer for judgment) is not a conviction," said Kenerly. He added that this appears to be the first time this issue has been raised concerning a candidate at the local and state level. Kenerly called John Hudson, chairman of the Rowan County Board of Elections, to make sure he was aware of Lyerly's court record. The Board of Elections certified Lyerly's election during a meeting May 13. Hudson said he sought advice from an attorney for the State Board of Elections, who told him the local board should not consider the matter unless there is an official challenge from a resident of the county. "If we get a challenge we will consider it. We haven't received a challenge," Hudson said. A Salisbury attorney, Hudson offered his view that Lyerly has not been convicted of a felony. "Prayer for judgment is not a conviction," he said. "She pleaded guilty; the court did not find her guilty. She has not been found guilty. No final judgment was entered against her." Hudson said if Lyerly had been found guilty, she would have been placed on the felon list and not allowed to vote. "According to her voting record, she has voted," Hudson said. "She was never sent over on a felony list." Ralph Walton, who finished third in the Democratic race for two seats on the county board, said he heard rumors about the matter just after the election. "I got a call," Walton recalled. "They said, 'Don't throw your signs away.' " Walton said Tuesday that he will not file a challenge, but he added that he stands ready to run if Lyerly is no longer on the ticket. He discounted the legal hair-splitting. "She pled guilty. She did it," he said. "Whether she was forgiven, the fact is she did it. She won't be able to get elected." Walton admitted he was surprised that a political newcomer amassed more than 6,000 votes. "I got Hillaryed," he said, pointing out that women all over the state won in the Democratic primary — all except Hillary Clinton. Walton received 3,739 votes. On Lyerly's MySpace page, she wrote a message late Monday evening entitled "Apology," but did not tie it to her candidacy. "I am sorry. Really sorry. Sometimes you don't even understand what you do. You just start on a path and once that direction is set in motion it is difficult to stop it. I am sorry," she wrote. Staff writer Shavonne Potts contributed to this story. Give her a chance : Tuesday, May 27, 2008 9:10 AMFirst off she was 19yrs old, still young and considered a young adult/child. She made a mistake, got caught and learned a lesson. Like so many we read about who commit crimes we wonder what would happen if they would learn from their mistakes and follow different a path as they grow. Well Rowan County this is one of those cases. She learned her lesson and she is taking a different path. She is not continuing down the wrong path of crime. We need to support and commend her for the course she has taken in her life. We need to stop condeming her and praise her for turning her life around. Not many people who have committed at crime at 19yrs of age would have chosen do so, they would have continued down the wrong path. Give her a chance to show you she has grown and that she is not that 19yr old child anymore.

Would Lyerly have won had the voters known about her pleading quilty to a felony? We will never know as she failed to disclose her past to the voters.

Just someone who kind of enjoys seeing all these Hall/Sides supporters so riled up and bitter, as usual. Because these are the same folks who will be unmerciful on Lyerly in the fall when its time to elect their 'pious' candidates Sides and Ford. You've got to appreciate the political strategy, yet blatant hipocrisy, of it all.

Ralph had the courage to speak with the Post, and yes, that is more than Laura Lyerly has done. You can’t blame him. It isn’t like Ralph has voiced some kind of vile thought that many others weren’t already thinking. He is right in imploring us to just “Let It Go.” He thought he’d found a magic button, even though it now appears that he hit “eject” instead. This should not be the forum to belittle Ralph Walton. Let this man's political ambitions rest in peace.

I was sort of worried about this issue until I read your rant (which sounds eerily like something self-proclaimed Republican "historian" Bill Ward would say). The Republican smear machine appears to be creaking to life a little early this election year. Don't get me wrong, I hope Lyerly beats Sides into the next county in November, maybe then we can get Tina Hall back on a Democratic agenda once Sides stops whispering in her ear. Also, "shagrin" is spelled "chagrin".

Yes, Voting Record Matters : Friday, May 23, 2008 8:37 AMMaking excuses for Ralph Walton having been a sore loser in '06 is an interesting political strategy in the '08 campaign. The fact is that Tina Hall is just as "real" a Democrat as she is a woman---something Ralph obviously deeply resents, given his outmoded sexist views. Yes, Tina Hall is a conservative Democrat---the only kind that can get elected in the general election, much to "Tax & Spend" Ralph's forever-angry shagrin. How is Tina Hall, a life-long Democrat, an imposter? Our county party has NO PLATFORM to give marching orders to our elected officials, so it cannot be said that she defied orders from "above." Tina's voting record includes: -No corporate welfare for multi-billion dollar corporations (something which she shares with Jim Sides, who has gotten into hot water with bigwig Republicans who don't like that stand). Does that make Tina a DINO (Democrat in Name Only)? -She joined with Jim Sides in opposing making property ownership a requirement for serving on the Land Use Steering Committee---as a vestige of Jim Crow laws. Does that make Tina a DINO? -She joined with Jim Sides in allowing the county's taxpayers to absorb the liability associated with alcohol served on county property, which a review of the Funkhouser vs. Rowan case is proving to have been quite expensive for the county. Does that make Tina a DINO? -She has advocated for improving education of Rowan's children and lowering our 40% dropout rate. Does that make Tina a DINO? -She has stood up for the Constitutional rights of property owners, farmers, businesses, and has taken thoughtful and principled stands on those rights when called upon to do so. Does that make Tina a DINO? Finally, Tina has emphasized fiscal responsibility over unsustainable spendthriftiness. If her hesitancy to be a "tax and spend liberal" is your primary objection, then it is Lettgo who is out of step with the party, and not Tina. We have worked diligently to change the old LBJ tax & spend label. So don't penalize Ms. Hall for your own failure to "lettgo" of bad habits! Jim Sides' stands have gotten him into hot water with his party because his stands are not "party line." And yet he wins each time he's on the ballot. Since many Democrats I talk with are already splitting their ticket in the Presidential race in November, I believe there will be a huge turnout of "Sides Democrats" in November, too. Instead of Tina being more like a Republican, have you considered that Jim Sides would make a darn good Democrat??? When you make all the excuses for Ralph Walton's back-stabbing Tina in '06, it emphasizes my point that the Democratic party certainly doesn't need to be dragged down by an angry little man with sexist attitudes just two short years later. Ralph has not, and will not, repent for the numerous flaws that make him undeserving of our vote.

Voting Record, Not Gender, Matters : Friday, May 23, 2008 7:07 AMI agree with "Amazed" in that a Democrat shouldn't normally support a Republican. But Tina Hall is a Democrat in name only, and I don't think any Democrat would have been in the wrong to decline to endorse Tina. In terms of their voting record and values, she is indistinguishable from Jim Sides, the ultimate far right wing Republican. I strongly agree that Democrat women are neither forgetful nor stupid, and should support female Democrat candidates, but not female candidates who parade around as wolves in sheeps clothing. I agree we should all try to get along, but for the good of the party the Democrats have to ferret out imposters like Tina and put strong candidates in office who represent true Democratic values. Otherwise this bitter divide will only continue.

Democrat women are not so forgetful, or stupid, to not remember the bitter, sore loser that Ralph was in 2006. The executive committee can make a better choice than Ralph. His defeat will be a priority should he succeed at getting this nomination.

For the Good of the County : Thursday, May 22, 2008 3:35 PMI am amazed by the number of bitter people who have posted here interpreting Ralph Walton's comment on Hillary Clinton affecting female voter turnout as sexist (they must be Hillary supporters bitter that Obama TROUNCED her in NC). Ralph doesn't appear to have any interest in challenging Ms. Lyerly, even though she deceived everyone in Rowan County by not disclosing her felony before the primary. If the women of Rowan County have anyone to be angry at, its Laura Lyerly. Don't direct your ire at Ralph just because he happens to be next in line (if it had been Terry Julian, the feminists would be ripping on him as well). Laura hasn't even bothered to address these charges, to either her supporters or her detractors (at least Ralph had the guts to speak to the Post). Do you really want an admitted felon, whose only public communications appear to be through MySpace, to carry the torch for feminism in Rowan County? Laura is probably a very nice girl and I'm sure she's sorry for this situation, but for the good of Rowan County, its women AND its men, we can do better. Sadly I think the damage has already been done.

I'm sorry Mr. Walton doesn't realize that Laura's fresh, new face and her promise of "building bridges" contrasted sharply with the Ralph Walton we've come to know over the years as unmeritorious of our vote. When he stabbed Tina Hall in the back in 2006 after she beat him at the polls, then announced his support for the "BBC" ticket, I was through with him. Ralph Walton is MORE unelectable than a felon, in my book. He is "Bridge Burner," and his sexist remarks prove it.

Republicans are hoping Ralph succeeds in his ploy. They are salivating at the ease with which Ralph Walton would self-destruct in a general election. His anti-women comments to the Post are proof positive of his flaws. For him to imply that he just lost because of his reproductive anatomy is a slap in the face to all women. With Laura's 6,000 votes to Ralph's 3739 votes, someone needs to teach him the difference between getting "Hillaryed" and getting SHELLACKED! If Ms. Lyerly bows out, the Democratic leadership should think twice about a Walton candidacy.

Some people make mistakes and it changes their life forever. They walk the straight and narrow thereafter. Others keep on making mistakes, and doing things illegal that effect others and they are still in office.. Our society has no integrity, thanks to the republicans; starting with the president all the way down to Rowan co. We live in a socialist country where the president can lie under oath and stay in office, but you all want to bust this girls chops over a petty issue.. Plenty of people have never been arrested that doesn't mean they have integrity or can hold public office.. Our entire political system is full of second best people especially at the top.. That's because all the intelligent, common sense entrepreneurs out there are smart enough to stay out of politics.. Only thing a politican needs is enough money to stay in the public eye and to talk a good game.. It's not about being qualified because they do what they wish once they're in office anyway... To judge this girl like some of you have is just Wrong.... What hypocrites !!

"Concerned Citizen" is right : Wednesday, May 21, 2008 6:58 AMI agree with Concerned Citizen, how do you gloss over an admission of committing a felony as a legal adult (whether or not the court gave a final judgment)? And why should we accept second best in our leaders? While a fresh face would be nice and a change from Sides/Hall is needed without question, I don't think anyone wants to sacrifice our integrity as a society to do so. Also, in addition to spelling Mr. Coltrain's name incorrectly, I think "The Inquisitor" may want to remember that there was only one female candidate in the Democratic primary.

Candidates brush with law : Wednesday, May 21, 2008 6:46 AMI believe that the writer of the article was wrong to characterize the opinions of lawyers in this matter as "legal hair-splitting." Perhaps the writer meant to say that Ralph Walton considered what the lawyers said as legal hair-spliting. Mr. Walton certainly does disregard what the lawyers have said. His stated desire to take advantage of this situation is disgusting. I am a Republican, so I could care less who is on the Democratic ticket; but I do care about a young lady who broke the law as a teenager, acknowledged her crime, and went on to lead a productive life. I hope that many take note of her sweet spirit in this matter in contrast to the ugly spirit of her rival.

Are we hurting that bad? : Wednesday, May 21, 2008 6:25 AM Has society become so bad that we think EVERYONE has legal issues from their past and therefore small things (although this isn't small) can be forgiven and we can run for office? I am SURE that there are people out there that have no shady past that can run this city and county (I know I have never been arrested). We as a society should not have to accept "second best" in regards to our leaders. She should NOT be allowed to run and should be banned from holding office. She plead guilty, therefore she is guilty. End of story. I sure don't want my tax dollars in her hands.
