Police cited a Charlotte man with marijuana possession after they say his license plate came back to an older, different vehicle than the one police spotted.

Joshua Marquis Byrd, 30, of the 1900 block of Village Brook Drive, was issued a citation Friday for fictitious tag, no insurance and simple possession of marijuana.

An officer conducted a traffic stop on an Infiniti near Lloyd Street, but upon searching in the system the vehicle came back to a 1984 Ford. The officer followed the vehicle near Bank and Grim streets. A man standing beside the vehicle was talking with the driver, later identified as Joshua Byrd, and both men reached into the passenger’s side.

The driver dropped “something” out of the window, said Police Capt. Melonie Thompson. The officer searched the area after asking the man outside to step away from the vehicle. The officer found a small bag of marijuana.

The officer asked Byrd to step outside of the vehicle and could smell marijuana coming from the car. Byrd told the officer he’d just gotten the car and forgot to replace the tag. The officer confiscated 1.3 grams of marijuana.

Byrd was convicted of assault with a deadly weapon inflicting serious injury, assault with a deadly weapon, assault on a law enforcement officer, possession with intent to sell a schedule II, common law robbery, and driving while license revoked.
